(1) A person shall not be eligible for initial or continued coverage under the pool if: (a) He or she is eligible for medicare benefits by reason of age or medical assistance established pursuant to sections 68-1018 to 68-1025; (b) He or she is a resident or inmate of a correctional facility, except that this subdivision shall not apply if such person is eligible for coverage under subdivision (1)(b) of section 44-4221; (c) He or she has terminated coverage in the pool unless twelve months have elapsed since such termination, except that this subdivision shall not apply if such person has received and become ineligible for medical assistance pursuant to sections 68-1018 to 68-1025 during the immediately preceding twelve months or if such person is eligible for coverage under subdivision (1)(b) of section 44-4221; (d) The pool has paid out one million dollars in claims for the person; or (e) He or she is no longer a resident of Nebraska.
(2) Coverage under the Comprehensive Health Insurance Pool Act shall terminate for any person on the date the person becomes ineligible under subsection
(1) of this section.
