Revised Statues - Chapter 35 Fire Companies and Firefighters

The county clerk shall determine whether the petitions contain the information required by law and have been signed by the required number of voters. The county clerk also shall determine if the proposed new districts to be created by the division will meet the requirements of section 35-502. When the county clerk determines that all requirements of law have been met, he shall submit the question of dividing the district and its property to the legal voters of the district at the next annual election of the district. If a majority of those voting vote in favor of the division, the county clerk shall certify such result to the board of the fire protection district, and to the county board of each county affected. Notice of such election shall be given in the manner provided by section 35-504, for notice of hearings.
