Revised Statues - Chapter 29 Criminal Procedure


29-1401.01: Petition; form; requirements.
The petition provided for in section 29-1401 shall include the following:

(1) Printed name, signature, and address of each petitioner. The omission of a printed name of a petitioner shall not disqualify a person as a petitioner;

(2) Date of signing by each petitioner, which date shall be not more than ninety days prior to the date of filing of the petition;

(3) A recital as to the reason for requesting the convening of the grand jury which shall include a specific reference to the statute or statutes which are alleged to have been violated; and

(4) A form of petition which shall be substantially as follows: .tb 10 42 IN THE DISTRICT COURT OF ................ COUNTY, NEBRASKA IN RE THE APPLICATION OF\) \) REGISTERED VOTERS OF .............. COUNTY,\) PETITION \) NEBRASKA, FOR A GRAND JURY.\) .tb 10 COME NOW the following registered voters of .......... County, Nebraska, and represent to the court that it is to the best interests of society that a grand jury be called by the court pursuant to sections 29-1401 to 29-1419 for the purpose of investigating alleged violations of the laws of Nebraska by ........ of ........ County, Nebraska, including, but not limited to the following alleged unlawful acts, to wit: WHEREFORE, the petitioners pray that an order be entered providing as follows: 1. That the clerk of the district court of ......... County, Nebraska, be ordered and directed to prepare and submit a grand jury list as provided by law. 2. That a grand jury be called to sit for the purpose of considering the alleged illegal acts set forth in this petition and for such other matters as might properly come before the jury. 3.
